The court of New York rejected the claim for slander submitted Stormi Daniels to the president Trump for his post to Twitter.

The federal judge in New York James Otero rejected the claim for slander submitted by a pornstar Stormi Daniels (a real name of Stephanie Clifford) to the U.S. President Donald Trump. The judge made this decision on the ground that Trump in full accordance with the 1st amendment to the Constitution guaranteeing freedom of speech had the right to express the opinion on Daniels on Twitter, that is to laugh at it.

As Reuters reports, the lawyer of the porn actress Michael Avenati said that his client intends to appeal against this decision and expressed opinion that “can still change”. He added that a rejection of this claim for protection of reputation in any way not to affect other judicial proceedings between Clifford and Trump.

Stephanie Clifford in March, 2018 accused the U.S. President of slander, having said that it had an affair with Trump, and not to recognize it, accuses her of a lie and slanders. According to her, Trump’s lawyer Michael Coen paid it in 2016 130 thousand dollars for silence, however on the document there was no signature of the president. Later the woman began to claim that in 2011 she was even threatened with punishment if she does not stop advertizing this communication. As proof of it Daniels showed the drawing of the person made by the artist which allegedly threatened her.

Trump in reply called her words “sketch”. “Bad work in which are engaged a fake news of media for fools”, – he wrote on the Twitter and placed the photo in which the shown Daniels compared the drawing of the man to a photo of her ex-husband.

In connection with Trump’s statements on Twitter Daniels also filed a lawsuit against it, considering that the president thereby meant that she brought false charges.

However the court considered a fake the man’s identikit presented in court by the claimant. The judge James Otero said that “if the claimant can, without being afraid of legal consequences, to express publicly the defendant, then and that has the right for similar steps”. According to court, Trump’s tweet is only the “intended exaggeration” characteristic of the American policy.

The lawyer of Donald Trump Charles Harder said that such verdict – “an absolute victory”. Now Stephanie Clifford has to pay legal costs of the party of the defendant, that is Donald Trump and his lawyers.
